These Terms of Use ("Terms") govern the purchase, use, and operation of the desktop computer hardware products ("Products") sold by ShenZhen Xinshengmei Technology CO., LTD ("we", "us", or "the manufacturer"). By purchasing or using a Product, you agree to these Terms.
1. Product Intended Use
The Products are general-purpose desktop computer hardware devices intended for local computing use. They are designed to operate as standalone hardware units. Any network connection (Ethernet, Wi-Fi, Bluetooth) is initiated and configured solely by you through the operating system or third-party software you choose to install.
2. No Mandatory Cloud Service or Remote Data Collection
The Products do not include any mandatory manufacturer-operated cloud service, telemetry system, or remote data collection mechanism. We do not automatically collect, receive, or store data generated during your use of the Product. All data you create or store on the Product (including files, system logs, application data, and settings) remains on the device‘s local storage under your sole control.
3. User Responsibility for Data
You are solely responsible for the data stored on your Product, including its backup, security, and deletion. We have no remote access to data stored on the device and do not provide data recovery services unless separately agreed in writing.
4. Software and Third-Party Services
The Product may be supplied with or may support operating systems and third-party software. Your use of such software is governed by the respective licenses and terms of the software providers. We are not responsible for the data practices of third-party software or services that you choose to install or use.
5. Warranty
One month replacement. Two years hardwares warranty, not cover the humen-made damage.
6. Limitation of Liability
To the extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Product, including loss of data, where such loss results from user actions, third-party software, or circumstances beyond our reasonable control. Nothing in these Terms limits liability that cannot be limited under applicable law.
7. Data Act Transparency
Information about the data-related characteristics of the Product is provided in the EU Data Act Transparency Statement accompanying the Product. That statement forms part of the product information and should be read together with these Terms.
8. Governing Law
These Terms are governed by the laws of People‘s Republic of China, without prejudice to mandatory consumer protection provisions applicable in the country where the Product is purchased.
